Representatives María Elvira Salazar (R-FL) and Madeleine Dean (D-PA) have introduced the "No Artificial Intelligence Fake Replicas And Unauthorized Duplications" (No AI FRAUD Act) bill. The proposed legislation aims to establish a federal framework to protect the individual rights of Americans to their image and voice against imitations and forgeries generated by artificial intelligence (AI).
According to Representative Salazar, the bill fills a gap in the law and gives artists and American citizens the power to protect their rights, creative work, and fundamental individuality online. She stated, "It is time for the bad actors using AI to be held accountable."
The abuse of AI technology has allowed for the unauthorized cloning and impersonation of individuals, enabling users to create counterfeit materials using images and voices of others. This misuse of technology has affected various individuals, from musicians and actors to athletes and even high school students, whose personal rights have been violated.
The No AI FRAUD Act has gained support from artists in the music industry who have faced direct attacks on their intellectual property due to the abuse of AI. State-level laws addressing these issues have been inconsistent and, in some cases, insufficient. The No AI FRAUD Act establishes a federal solution with basic protections for all Americans.
The proposed legislation reaffirms that the image and voice of all individuals are protected, granting people the right to control the use of their identifying characteristics. It empowers individuals to enforce this right against those who facilitate, create, and distribute AI fraud without their permission. The bill also balances these rights with the protections of the First Amendment to safeguard expression and innovation.
Representative Dean emphasized that the bill not only protects artists and performers but also provides all Americans with the tools to protect their digital personas, preventing AI from being used for harassment, intimidation, or abuse. She expressed her encouragement at the bipartisan collaboration to pass these crucial protections.
Several other representatives have also expressed their support for the No AI FRAUD Act. Representative Moran highlighted the importance of protecting American innovation by preventing AI cloning, impersonation, and forgeries from undermining artistic expression. Representative Morelle emphasized the need for immediate action to stop AI abuse through federal legislation, empowering victims and putting an end to AI fraud.
Representative Wittman emphasized the need to protect the integrity of American art as the use of AI becomes more prevalent in society. He stated that the No AI FRAUD Act is a crucial first step in safeguarding the intellectual property of artists and creators from potential exploitation by malicious actors.
The full text of the bill can be found on the official website, and a one-page summary of the legislation is also available.
With the introduction of the No AI FRAUD Act, Representatives Salazar and Dean, along with their colleagues from both parties, aim to combat the threats posed by AI imitations and forgeries and protect the rights and creative work of individuals in the United States.
